How to Include Your Pet in Your Estate Plan

Get The Legal Help You Need

Our pets are more than animals—they’re companions, family members, and loyal friends who bring joy and love into our lives every day. But have you ever thought about what would happen to them if you were no longer around? This is a reality that many pet owners are increasingly confronting as they make long-term plans, realizing that, just like other loved ones, pets need security and care when they’re no longer able to provide it.

Traditionally, estate planning focused on transferring assets to human beneficiaries, but that’s changing. Today, people are recognizing the importance of including pets in their wills and trusts, ensuring that these cherished companions receive the love and support they need even in their absence

A recent article in Time, “How to Make Sure Your Pet Is Cared for When You Die,” highlights several ways to include pets in estate plans:

Will Beneficiary – You can name a trusted person in your will to inherit your pet along with funds for their care. However, this approach relies on trust, as there’s no guarantee the money will be spent specifically on your pet.

Will Trust – Another option is creating a pet trust in your will. This allows a probate court to appoint a trustee and a caregiver to ensure your pet’s needs are met. All states except Minnesota currently recognize these trusts.

Traditional Trust – Setting up a traditional trust for your pet gives you more control over their long-term care. You can fund the trust with specific assets and name a trustee to oversee its management. Often, the trustee may also be the pet’s caregiver, though it’s not required.

Considering these options can help provide peace of mind that your pet will be well cared for after your lifetime.
